Terms of Service

1. Definitions

  • "Service" refers to our (https://getwcag.com) and all sub domains, WCAG compliance scanner, including all features, tools, and website accessibility audit functionalities.
  • "User" refers to any individual or entity that accesses or interacts with our Service.
  • "Scan" refers to the process of auditing a website using our Service.
  • "Project" refers to a scanned website assigned under a User’s account.

2. Acceptance of Terms

  • You have read, understood, and agree to these Terms.
  • You have the legal authority to enter into this agreement on behalf of yourself or the entity you represent.
  • You will not use our Service for illegal, harmful, or fraudulent activities.

If you do not agree, you must immediately stop using our Service.

3. Service Usage & Limitations

3.1 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for lawful purposes.

3.2 Service Limitations

  • We do not guarantee that our WCAG scanner will detect every accessibility issue.
  • Automated scans do not replace manual testing or legal consultation.
  • We reserve the right to modify, suspend, or discontinue any part of the Service without prior notice.

3.3 User Responsibilities

  • You must provide accurate information when using our Service.
  • You are responsible for all actions performed under your account.
  • You may not interfere with the Service’s functionality, attempt to exploit vulnerabilities, or reverse-engineer the software.

4. Payments & Refund Policy

4.1 Subscription & Upgrades

Access to certain features requires payment. If you upgrade a project, you will be charged immediately.

4.2 Refund Policy

Refunds are only available if:

  • The User has not initiated any scans after upgrading their project.
  • The refund request is made within 14 days of the upgrade.
  • Our service fails and scan your website.
  • No excessive use, abuse, or suspicious activity is detected.

Refunds are NOT available if:

  • A scan has been performed.
  • The Service was used for commercial purposes and provided results.
  • The refund request is made beyond 14 days.

5. Disclaimer of Warranties & Liability Limitations

5.1 No Warranty

The Service is provided "AS IS" and "AS AVAILABLE." We do not guarantee that the Service is error-free or that it will identify every WCAG compliance issue. We are not responsible for damages, interruptions, or performance issues caused by third-party dependencies (e.g., hosting providers, browsers, software conflicts).

5.2 Limited Liability

To the fullest extent permitted by law, we are NOT liable for:

  • Direct, indirect, incidental, or consequential damages from using our Service.
  • Loss of revenue, website data, SEO ranking, or business opportunities.
  • Any changes you make based on our scan results.
  • Legal claims or complaints related to website accessibility compliance.

Your sole remedy if you are dissatisfied with the Service is to stop using it.

6. Data & Privacy

6.1 Collection & Use of Data

We may collect technical and usage data for improving the Service. We do not sell your personal data to third parties. By using the Service, you consent to our data collection practices.

6.2 Data Storage & Security

We use industry-standard security to protect User data. We do not guarantee complete immunity from cyber threats.

7. Intellectual Property & Marketing Rights

7.1 Ownership

The Service, including software, branding, and content, is our exclusive property. You may not copy, modify, distribute, or resell any part of our Service without our permission.

You retain ownership of all content you upload or scan using the Service, but we may retain the results of your scan for analytical purposes, troubleshooting, or further enhancement of the Service

7.2 Marketing Rights

By using our Service, you grant us the right to:

  • Display your company name and logo on our homepage and marketing materials.
  • Use your company name as a testimonial or case study, unless you opt out by notifying us in writing.
  • List your company in our client portfolio to showcase businesses utilizing our accessibility solutions.

If you do not want your company name to be publicly displayed, you may request exemption in writing.

8. Termination & Account Suspension

8.1 Termination by User

You may terminate your account at any time. However, no refunds will be issued unless conditions in Section 4.2 apply.

8.2 Termination by Company

We reserve the right to suspend or terminate your access if:

  • You violate these Terms.
  • Suspicious or fraudulent activity is detected.
  • Your use of the Service poses a security risk.

9. Governing Law & Dispute Resolution

These Terms are governed by swedish law. Any disputes shall be resolved exclusively through arbitration in Sweden. You waive your right to a class action lawsuit.

We use third-party services to process payments, but they are bound by their own privacy policies. We encourage users to review these policies

11. Changes to These Terms

We may update these Terms at any time. Users will be notified of significant changes via email or our website. Continued use of the Service after changes indicates acceptance.

12. Right to Discontinue or Suspend Service

We reserve the right to discontinue, suspend, or modify the Service at any time, with reasonable notice, for any reason, including but not limited to operational, technical, or legal reasons. In the event that we decide to discontinue the Service, we will provide at least 30days advance notice to paying customers and clients with active contracts.

For enterprise or contractual clients, the terms of service outlined in the signed contract will govern any service shutdown, including the timeline for notification and any potential refunds or alternatives. We will make reasonable efforts to offer a suitable transition plan to minimize disruptions.

We are committed to maintaining the quality of our Service and will work with you to ensure a smooth transition in the event of any service discontinuation.
